The general terms and conditions apply to the legal relationships arising from the ordering of goods (hereinafter referred to as “Goods”) through the ordering environment located on the website of Elav Tuli OÜ (hereinafter referred to as “Elav Tuli”) at www.elavtuli.ee (hereinafter referred to as the “E-store”).
 

In addition to these general terms and conditions, the relations between the Customer and Elav Tuli are governed by the applicable laws of the Republic of Estonia, the price list of the Goods in the E-store, and established good practices.

  1. Order Procedure for Goods

    1.1. The Customer does not need to register as a user of Elav Tuli’s E-store to order Goods.
    1.2. The Customer selects the desired Goods in the E-store, specifies the quantity, fills in the information fields necessary for delivery, agrees to the terms and conditions, and pays for the Goods.
    1.3. The delivery costs for the ordered Goods are covered by Elav Tuli if the total order amount is at least 300 euros (excluding delivery costs).
    1.4. The Customer can pay for the confirmed order via online banking.
    1.5. The order becomes effective once the payment for the ordered Goods has been received in Elav Tuli’s bank account.
    1.6. Elav Tuli will deliver the ordered Goods to the Customer according to the delivery method selected by the Customer at the time of placing the order: either to a post office, parcel machine, or by courier to the specified postal address.
    1.7. When the order arrives at an Omniva or Itella SmartPost parcel machine, a message will be sent to the Customer’s mobile phone and email containing the location of the parcel machine, opening hours, and a personal door code. Upon entering the code into the parcel machine, the door will open and the Customer can retrieve the package. Shipments are usually stored free of charge in the parcel machine for 7 calendar days from the arrival of the message to the Customer’s mobile phone and email. After 7 days, the Customer will be contacted again regarding the retrieval of the package.
    1.8. The courier will deliver the Goods to the address specified by the Customer and will contact the Customer by phone to arrange the handover. If the courier is unable to contact the Customer by phone, the goods will be left at the nearest terminal. Shipments are stored at the terminal usually for 7 calendar days from the day of arrival. After this period, the order will be canceled. In the event of order cancellation, Elav Tuli will retain the handling fee.
    1.9. Elav Tuli OÜ is the responsible processor of personal data. Elav Tuli will forward the personal data necessary for making payments to the authorized processor, Montonio Finance OÜ.

  2. Customer Rights

    2.1. The Customer has the right to order Goods from the E-store at the price set by Elav Tuli and under the fixed terms and conditions.
    2.2. The Goods sent to the Customer must be correct, complete, and comply with the conditions set by Elav Tuli.
    2.3. The Customer has the right to submit complaints regarding the Goods order and the Goods themselves to Elav Tuli’s email address info@elavtuli.ee within 30 calendar days from receiving the Goods.
    2.4. The Customer has the right to withdraw from the Goods order from the moment of ordering until 14 calendar days after receiving the Goods. To cancel the order, the Customer must submit a written or email request to Elav Tuli OÜ. In the written request for order cancellation, the Customer must provide the bank account number and the name of the account holder to which the refund should be made. If the Customer withdraws from the order, they must return the Goods in their original packaging, unused and undamaged, immediately but no later than 30 calendar days from the date of sending the withdrawal request. Elav Tuli will refund the amount paid for the returned Goods to the Customer no later than 30 calendar days from receiving the returned Goods based on the withdrawal notice.
    2.5. If the Goods returned by the Customer have been used, Elav Tuli OÜ has the right to demand compensation for damages up to the sale price of the Goods, depending on the decrease in the value of the Goods. This amount will be deducted from the sum to be refunded to the Customer.
  3. Customer Obligations

    3.1. When placing an order, the Customer is required to provide the necessary information for the order: first and last name, exact address (street, house number, apartment number, postal code, city/town or village/county), contact phone number, and email address.
    3.2. If the Customer and the recipient of the Goods are different, the Customer must provide the information specified in point 3.1 for the recipient as well.
    3.3. If the information provided by the Customer is incorrect and/or incomplete and does not meet the requirements specified in point 3.1, Elav Tuli does not guarantee the proper fulfillment of the Goods order. If possible, Elav Tuli will contact the Customer to clarify incorrect or incomplete information.
    3.4. By placing an order, the Customer confirms that they agree to the terms and conditions set forth in these general ordering conditions and undertakes to comply with them.
  4. Elav Tuli’s Rights

    4.1. If the Customer does not fulfill the obligations imposed on them by these general ordering conditions, Elav Tuli does not guarantee the validity and/or proper dispatch of the Goods order.
    4.2. If the Customer does not fulfill the payment obligation correctly, Elav Tuli OÜ has the right to publish the Customer’s information in the payment default register.
    4.3. Elav Tuli OÜ has the right to withdraw from the sales transaction and demand the return of the Goods if, due to an error or technical fault, the price indicated for the product in the online store is significantly lower than the market price of the product.
  5. Elav Tuli’s Obligations

    5.1. Elav Tuli undertakes to deliver the correct and complete Goods to the Customer.
    5.2. Elav Tuli undertakes to accept and document all Customer complaints.
    5.3. Elav Tuli undertakes to resolve the Customer’s complaint within 7 working days if the reasons for the complaint are not dependent on the Customer. If the cause of the complaint is due to the Customer, the Customer must rectify it immediately.
